Fine Coffee Company Terms and Conditions (“Agreement”)

Please read these Terms and Conditions (“Agreement”, “Terms and Conditions“, “Warranty and Support“) carefully before using www.finecoffeecompany.com (“the Site”) operated by Fine Coffee Company (“us”, “we”, or “our”). This Agreement sets forth the legally binding terms and conditions for your use of the Site at www.finecoffeecompany.com.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions. Capitalised terms are defined in this Agreement.

Intellectual property
The Site and its original content, features and functionality are owned by Fine Coffee Company and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

Termination
We may terminate your access to the Site, without cause or notice, which may result in the forfeiture and destruction of all information associated with you. All provisions of this Agreement that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Links to other Sites
Our Site may contain links to third-party sites that are not owned or controlled by Fine Coffee Company.

Fine Coffee Company has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third party sites or services. We strongly advise you to read the terms and conditions and privacy policy of any third-party site that you visit.

Governing law
This Agreement (and any further rules, policies, products, or guidelines incorporated by reference) shall be governed and construed by the legislation of Johor, Malaysia, without giving effect to any principles of conflicts of law. Buyers will be fully responsible for the use of www.finecoffeecompany.com and any of its products or services in their nation.

Errors, corrections and changes
We do not represent or warrant that the Site will be error-free, free of typo errors, free of viruses, or other harmful components, or that defects will be corrected. We do not represent or warrant that the information available on or through the Site will be correct, accurate, timely or otherwise reliable. We may make to the features, functionality or content of the Site at any time. We reserve the right in our sole discretion to edit or delete any documents, orders, information or other content.

Our refund policy
www.finecoffeecompany.com do not issue refunds after the product is shipped. By making an order, the buyer agrees that he or she had carefully read ”Warranty and Support” section and fully understands the usage of the product. We only make exceptions with this rule on a case by case basis at our sole discretion. The deadline for any refund claim is one week after the delivery date. A restocking fee of 20% of the receipt will be charged for any returns, together with the cost of delivery made to and from delivery location, tax and duties incurred and any prevailing charges. The refund is issued to you after we receive the return. Return items should be in original condition and in full package, else missing items or damages will be as charged. Credit card, shipping fees, tax, duties, installation, cleaning agents, coffee beans and other misc service fees are not refundable.

Ownership
Our products are provided “as is” without additional warranty beyond the given warranty period of any kind, either expressed or implied. In no event shall our company or its agents be liable for any damages including, but not limited to, direct, indirect, special, punitive, incidental or consequential, or other losses or quality of results arising out of the use of or inability to use our products. Buyers and users will bear full responsibility for the utilisation of the goods or services sold or distributed by agents or resellers from www.finecoffeecompany.com and are fully accountable on their own to ensure compliance with the local technical requirements of specifications. That concludes but not limited to power specifications of wattage, frequency, ampere, plugs, etc.

Installations
We are not obligated to install any of our products. Installation is a paid service that is not included in the price and will be available base on location at our sole discretion. In the event an installation is arranged, our company or its agents are not liable for any damages including, but not limited to, direct, indirect, special, punitive, incidental or consequential, or other losses arose from the installation. Our agents are not responsible nor liable for any modifications or installations of any additional facilities, which includes but not limited to plumbing, installation of wires or power points, painting, trunking, demolition, disposal, hacking, or any forms of renovations. 

Third party services
We may allow access to or advertise certain third-party product or service providers (“Merchants”) from which you may purchase certain goods or services. You understand that we do not operate or control the products or services offered by Merchants. Merchants are responsible for all aspects of order processing, fulfilment, billing and customer service. We are not a party to the transactions entered into between you and Merchants. You agree that use of or purchase from such Merchants is at your sole risk and is without warranties of any kind by us, expressed, implied or otherwise including warranties of title, fitness for purpose, merchantability or non-infringement. Under no circumstances are we liable for any damages arising from the transactions between you and merchants or for any information appearing on merchant sites or any other site linked to our site.

Registration/purchase
Purchasing from the Site may optionally require you to register. If registration is performed, you agree to provide us with accurate, complete registration and purchase information. Your registration must be done using accurate information. Each registration is for your personal use only.

We do not permit:

  1. Any other person using the registered sections under your name.
  2. Access through a single name being made available to multiple users on a network. You are responsible for preventing such unauthorised use.

finecoffeecompany.com retains the sole right and authority to accept or reject your registration, or to terminate registration once accepted, for any reason that it deems appropriate. If the use of the product will be used out of the locality of any service from www.finecoffeecompany.com, we have the full right to reject or cancel the order.

Commercial Use Declaration and Indemnification (Singapore)

By proceeding with a purchase from Fine Coffee Company, its affiliates, owners, or resellers, the buyer explicitly acknowledges and confirms that all espresso machines or coffee grinders sold by Fine Coffee Company, with the exception of the model Bezzera Aria, are intended exclusively for commercial use within Singapore. It is the buyer’s sole responsibility and discretion to use these products in domestic or other similar settings. Fine Coffee Company, its affiliates, or resellers disclaim any liability or responsibility for any non-compliance with or violation of domestic appliance laws or regulations in the buyer’s or end user’s jurisdiction.

In respecting our customers’ privacy and due to the limitations of the information provided to us, we do not verify or cross-reference the details of customer addresses, names, or any other submitted information against any commercial establishment records.

By purchasing, the buyer agrees to defend, indemnify, and hold harmless Fine Coffee Company, its affiliates, and resellers from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from the buyer’s misuse of the product, non-compliance with domestic appliances laws, or any claim that the product caused damage to a third party. This defense and indemnification obligation will survive these conditions and the buyer’s use of the purchased product.

On taxes
For Singapore orders: Prices are inclusive of GST and various taxes which are absorbed by www.finecoffeecompany.com
For Malaysia orders: Orders are currently subjected to customs taxes and fees as goods will be distributed from outside Malaysia.
For International orders: Orders are subjected to customs taxes and fees as accord to your nation legislated law.

International and Malaysian buyers are responsible for the import duties, taxes, brokerage fees incurred in the purchase of any products from www.finecoffecompany.com

Buyers are responsible for checking with their country’s customs office to determine what are the additional costs will be. Insurance will not cover the products entirely and are provided in “as is” basis, and the additional requirement of better insurance requirements offered by the freight forwarders will be as charged. Buyers are to inform us the request of purchasing additional insurance before delivery takes place.

Currency used
www.finecoffeecompany.com accepts both United States Dollars(US$), and Singapore Dollars(SG$) catered for different nations. In the event, a buyer is not residing or not purchasing to Singapore and Malaysia, the currency US$ should be used.

www.finecoffeecompany.com reserves the right to reject or amend any orders submitted with a wrong currency setting. We reserve the rights to have the foreign exchange rates altered, amended, priced as accord to market rates and can be done before, during or after a transaction made.

Payments
You represent and warrant that if you are purchasing something from Merchants or us that any credit information you supply is accurate and complete, charges incurred by you will be honoured by your credit card company, and you will pay the charges incurred by you at the posted prices, including any applicable taxes.

On deliveries
www.finecoffeecompany.com engage third party couriers or our agents to handle all deliveries. We do not operate or control the products or services offered by third party couriers or agents, and you agree that we are not responsible for all aspects of order processing, fulfilment, billing and customer service provided by the courier company, agents or their employees.

You agree that purchase of our products and use of such couriers is at your sole risk and is without warranties of any kind by us, expressed, implied or otherwise including fitness for purpose, the condition of goods delivered, delivery schedules, lost of parcels, etc. Under no circumstances are we liable for any damages arising from the service between you and couriers or for any information appearing on courier sites or any other site linked to our site.

If a tracking number had been provided, buyers would have to check on their own with the courier company on the status or where about are the parcels

Information disclosure
You may not disclose any order information including, but not limited to, Order ID, download link, discounts, invoice, etc.

You acknowledge that the release of any personal information without the consent of any employees, owner, director, affiliates, shareholders, contractors or agents of www.finecoffeecompany.com is a criminal offence of invasion of privacy and is a liable to accept the full extent of legal pursue upon offence.

Personal information includes but not limited to photographs, sketches, contact numbers, names, nicknames, addresses, alias, signatures, emails, or description of the person or information in various text or explicit description. 

The medium of channels includes but not limited to social media, forums, words of mouth, mainstream media, by text or graphically.

Unlawful activity
We reserve the right to investigate complaints or reported violations of this Agreement and to take any action we deem appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses and traffic information.

Fabrication of forged documents, cannibalism of parts from our products and claim warranty, using purchased product’s warranty to claim for machines purchased from other sources, are criminal offences described as “cheating” under the penal code. Violators will be reported to the authorities, and all forms of warranty will be void with immediate effect.

Limited license
Fine Coffee Company grants you a non-exclusive, non-transferable, limited license to use the Site in accordance with this Agreement.

Limitation of liability
In no event shall Fine Coffee Company, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for damages, direct or consequential, resulting from your use of the Site, and you agree to defend, indemnify and hold us harmless from any claims, losses, liability costs and expenses, including but not limited to attorney’s fees, arising from your violation of any third-party’s rights.

Warranty Disclaimer
Your use of the Site is at your sole risk. The Site is provided on an “as-is” and “as-available” basis. The Site is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. Fine Coffee Company, its subsidiaries, affiliates, and its licensors do not warrant that a) the Site will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Site is free of viruses or other harmful components, or d) the results of using the Site will meet your requirements.

For information on the coverage of the product’s warranty, buyers are to read, understand and fully agreeable to the section “Warranty and Support”  before any purchase.

In the event a warranty claim is required, www.finecoffeecompany.com will at it’s discretion decide if onsite service or repair is possible. If a return for repair or service is required, www.finecoffeecompany.com will not be responsible for any costs arising from the following but not limited to freight, taxes, or damages incurred during transportation to and fro a service centre. Warranty starts with effect from the date product was purchased and delivered,  the warranty registration page serves wholly as a reference.

The buyer will also acknowledge that the safety of the devices, accompanied liabilities, risk of use, expected performance, limitations of use are issues between the manufacturer and the buyer directly.

Free gifts in the form of products or services provided with, prior or after any purchases are and provided in “as is” basis, are indemnified from any liabilities and not covered by warranties of any kind, whether expressed or implied.

Changes to this agreement
We reserve the right, at our sole discretion, to modify or replace these Terms and Conditions by posting the updated terms on the Site. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

Please review this Agreement periodically for changes. If you do not agree to any of this Agreement or any changes to this Agreement, do not use, access or continue to access the Site or discontinue any use of the Site immediately.
